# Terms and Conditions for ALFA HR

## 1. Agreement to Terms

By downloading, installing, accessing, or using the ALFA HR Mobile application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not use the App and must uninstall it immediately.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and [Company Name] ("Company," "we," "us," or "our") regarding your use of the App.

## 2. Definitions

- **"App"** means the ALFA HR Mobile mobile application and all related services.

- **"Company"** means your employer or the organization that provides you access to the App.

- **"Service"** means all services, features, and functionality provided through the App.

- **"User Content"** means any data, information, or content you submit, upload, or transmit through the App.

- **"Account"** means your user account registered with the App.

## 3. Eligibility and Account Registration

### 3.1 Eligibility

You must be at least 18 years old and have the legal capacity to enter into binding agreements to use the App. By using the App, you represent and warrant that:

- You are at least 18 years old

- You have the authority to enter into these Terms

- Your use of the App will not violate any applicable law or regulation

- You are an authorized employee or representative of the Company providing access to the App

### 3.2 Account Registration

- You must provide accurate, current, and complete information during registration

- You are responsible for maintaining the confidentiality of your account credentials

- You are responsible for all activities that occur under your account

- You must immediately notify your employer's IT department or system administrator of any unauthorized use of your account

- You may not share your account credentials with any third party

- The Company reserves the right to suspend or terminate your account at any time for violation of these Terms

### 3.3 Account Security

- You are solely responsible for maintaining the security of your account

- You must use strong, unique passwords

- You must enable biometric authentication if available

- You must log out of the App when using shared devices

- The Company is not liable for any loss or damage arising from unauthorized access to your account due to your failure to maintain account security

## 4. License to Use

### 4.1 Limited License

Subject to your compliance with these Terms, the Company grants you a limited, non-exclusive, non-transferable, revocable license to:

- Download and install the App on your personal mobile device

- Use the App solely for authorized business purposes related to your employment

- Access and use the features and services provided through the App

### 4.2 License Restrictions

You may NOT:

- Copy, modify, distribute, sell, or lease any part of the App

- Reverse engineer, decompile, or disassemble the App

- Remove, alter, or obscure any proprietary notices or labels

- Use the App for any illegal or unauthorized purpose

- Use the App to violate any laws or regulations

- Interfere with or disrupt the App or servers connected to the App

- Attempt to gain unauthorized access to the App or related systems

- Use automated systems (bots, scrapers) to access the App

- Share your account or allow others to use your account

- Use the App in any manner that could damage, disable, or impair the App

## 5. Intellectual Property Rights

### 5.1 Ownership

All rights, title, and interest in and to the App, including but not limited to:

- Software, code, and technology

- User interface and design

- Trademarks, logos, and brand names

- Documentation and materials

- All intellectual property rights

are and shall remain the exclusive property of the Company and its licensors.

### 5.2 User Content

- You retain ownership of any User Content you submit through the App

- By submitting User Content, you grant the Company a worldwide, royalty-free, perpetual, irrevocable, non-exclusive license to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Content for the purpose of providing and improving the Service

- You represent and warrant that you have all necessary rights to grant the above license

- The Company reserves the right to remove any User Content that violates these Terms or applicable laws

### 5.3 Feedback

Any feedback, comments, or suggestions you provide regarding the App may be used by the Company without any obligation to compensate you.

## 6. Acceptable Use

### 6.1 Permitted Use

You may use the App only for:

- Legitimate business purposes related to your employment

- Attendance tracking and time management

- Accessing HR-related information and services

- Communication with your employer and colleagues

- Other purposes explicitly authorized by your employer

### 6.2 Prohibited Activities

You must NOT use the App to:

- Violate any applicable laws, regulations, or third-party rights

- Transmit any malicious code, viruses, or harmful software

- Engage in any fraudulent, deceptive, or illegal activities

- Harass, abuse, or harm other users

- Collect or store personal data about other users without authorization

- Impersonate any person or entity

- Interfere with the security or integrity of the App

- Attempt to circumvent any security measures

- Use the App in any way that could damage the Company's reputation

- Violate your employer's policies or code of conduct

## 7. Location Tracking and GPS Services

### 7.1 Location Tracking

The App includes GPS tracking functionality for attendance and employee location monitoring. By using the App, you acknowledge and agree that:

- Location tracking may be active during your work hours

- Your location data will be collected, stored, and transmitted to your employer

- Location tracking is used solely for business purposes (attendance, time tracking, employee monitoring)

- You may not disable or interfere with location tracking if required by your employer

- Location data may be used for compliance, security, and business management purposes

### 7.2 Background Location

- The App may track your location even when running in the background

- Background location tracking is necessary for automatic attendance tracking

- You consent to background location tracking by using the App

- You may be required to grant background location permissions for the App to function properly

### 7.3 Location Data Accuracy

- The Company does not guarantee the accuracy of location data

- Location accuracy depends on various factors including GPS signal, device capabilities, and environmental conditions

- The Company is not liable for any consequences arising from inaccurate location data

## 8. Privacy and Data Protection

### 8.1 Privacy Policy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the collection, use, and disclosure of your information as described in the Privacy Policy.

### 8.2 Data Collection

You acknowledge that the App collects, processes, and stores various types of data including:

- Personal information (name, email, employee ID, etc.)

- Location data (GPS coordinates)

- Device information

- Usage data

- Attendance and HR-related data

### 8.3 Data Security

- The Company implements reasonable security measures to protect your data

- However, no system is completely secure

- You acknowledge that data transmission over the internet carries inherent risks

- The Company is not liable for any unauthorized access to your data that occurs despite reasonable security measures

## 9. Service Availability and Modifications

### 9.1 Service Availability

- The Company does not guarantee that the App will be available at all times

- The App may be unavailable due to maintenance, updates, technical issues, or other reasons

- The Company reserves the right to modify, suspend, or discontinue the App or any part thereof at any time without notice

- The Company is not liable for any loss or damage resulting from App unavailability

### 9.2 Updates and Modifications

- The Company may update, modify, or change the App at any time

- You may be required to install updates to continue using the App

- Updates may include bug fixes, new features, or security patches

- The Company is not obligated to provide updates or support for older versions of the App

### 9.3 Feature Changes

- The Company reserves the right to add, modify, or remove features at any time

- The Company may discontinue certain features without notice

- The Company is not liable for any loss resulting from feature changes or discontinuation

## 10. Third-Party Services

### 10.1 Third-Party Integration

The App may integrate with or use third-party services, including:

- Firebase (Google) for push notifications and analytics

- Google Play Services for app distribution

- Other third-party services as necessary

### 10.2 Third-Party Terms

- Your use of third-party services is subject to their respective terms and conditions

- The Company is not responsible for third-party services or their terms

- The Company does not endorse or guarantee third-party services

- You acknowledge that third-party services may have their own privacy policies and data practices

## 11. Disclaimers and Limitations of Liability

### 11.1 Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

- WARRANTIES OF MERCHANTABILITY

- FITNESS FOR A PARTICULAR PURPOSE

- NON-INFRINGEMENT

- ACCURACY, RELIABILITY, OR COMPLETENESS OF DATA

- UNINTERRUPTED OR ERROR-FREE OPERATION

THE COMPANY DOES NOT WARRANT THAT:

- THE APP WILL MEET YOUR REQUIREMENTS

- THE APP WILL BE AVAILABLE AT ALL TIMES

- THE APP WILL BE ERROR-FREE OR SECURE

- DEFECTS WILL BE CORRECTED

- THE APP IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS

### 11.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY SHALL NOT BE LIABLE FOR:

- ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES

- LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES

- DAMAGES RESULTING FROM YOUR USE OR INABILITY TO USE THE APP

- DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO OR USE OF YOUR ACCOUNT

- DAMAGES RESULTING FROM ANY CONDUCT OR CONTENT OF THIRD PARTIES

- DAMAGES RESULTING FROM ANY PRODUCTS OR SERVICES OF THIRD PARTIES

IN NO EVENT SHALL THE COMPANY'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO ACCESS THE APP (IF ANY) OR $100, WHICHEVER IS GREATER.

### 11.3 Exclusions

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. In such jurisdictions, some of the above exclusions may not apply to you.

## 12. Indemnification

You agree to indemnify, defend, and hold harmless the Company, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:

- Your use or misuse of the App

- Your violation of these Terms

- Your violation of any rights of another party

- Your violation of any applicable laws or regulations

- Any User Content you submit through the App

## 13. Termination

### 13.1 Termination by You

You may stop using the App at any time by:

- Uninstalling the App from your device

- Contacting your employer to deactivate your account

- Ceasing to access or use the App

### 13.2 Termination by Company

The Company may suspend or terminate your access to the App at any time, with or without cause or notice, for any reason including:

- Violation of these Terms

- Violation of your employer's policies

- Unauthorized use of the App

- Fraudulent or illegal activity

- At the request of your employer

- For any other reason deemed necessary by the Company

### 13.3 Effect of Termination

Upon termination:

- Your right to use the App will immediately cease

- You must immediately uninstall the App from your device

- The Company may delete or retain your account and data at its discretion

- All provisions of these Terms that by their nature should survive termination shall survive

## 14. Employment Relationship

### 14.1 No Employment Guarantee

- These Terms do not create an employment relationship between you and the Company (the App provider)

- Your employment relationship is with your employer

- The Company is not responsible for your employment terms, conditions, or termination

- Use of the App does not guarantee continued employment

### 14.2 Employer Policies

- You must comply with all employer policies and procedures

- Your employer may have additional terms and conditions for App use

- Violation of employer policies may result in termination of your account and employment

- The Company may share information with your employer as necessary for business purposes

## 15. Compliance with Laws

### 15.1 Applicable Laws

You agree to comply with all applicable local, state, national, and international laws and regulations when using the App, including but not limited to:

- Data protection and privacy laws (GDPR, CCPA, etc.)

- Employment and labor laws

- Intellectual property laws

- Export control laws

- Anti-discrimination laws

### 15.2 Export Restrictions

- The App may be subject to export control laws

- You may not export or re-export the App in violation of any applicable export control laws

- You represent that you are not located in a country that is subject to export restrictions

## 16. Dispute Resolution

### 16.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Jurisdiction/Country], without regard to its conflict of law provisions.

### 16.2 Dispute Resolution Process

Any disputes arising out of or relating to these Terms or the App shall be resolved through:

The failure of the Company to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

### 17.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without the Company's prior written consent. The Company may assign these Terms without restriction.

### 17.5 Notices

- Notices to you may be provided through the App, email, or other means

- You are responsible for ensuring your contact information is current

- Notices to the Company should be sent to the contact information provided in Section 18

### 17.6 Force Majeure

The Company shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to natural disasters, war, terrorism, labor disputes, or internet failures.

## 19. Changes to Terms

The Company reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting the updated Terms in the App or on our website.

- The Company may notify you of significant changes through the App, email, or other means

- The "Last Updated" date at the top of these Terms will indicate when changes were made

- Your continued use of the App after changes are made constitutes acceptance of the updated Terms

### 19.3 Your Rights

If you do not agree to the modified Terms, you must:

- Stop using the App immediately

- Uninstall the App from your device

- Contact your employer to deactivate your account

## 20. Acknowledgment

BY USING THE APP, YOU ACKNOWLEDGE THAT:

- You have read and understood these Terms

- You agree to be bound by these Terms

- You understand that violation of these Terms may result in termination of your account and potential legal action

- You understand that your employer may have additional policies governing App use

- You consent to the collection and use of your data as described in the Privacy Policy

- You understand that the App is provided for business purposes and is not a consumer product

## 21. Special Provisions for Location Tracking

### 21.1 Mandatory Location Tracking

If your employer requires location tracking as a condition of employment:

- You must grant location permissions for the App to function

- You may not disable location tracking during work hours

- Failure to enable location tracking may result in disciplinary action by your employer

- The Company is not responsible for employment consequences resulting from location tracking issues

### 21.2 Location Data Ownership

- Location data collected through the App is the property of your employer

- Your employer has the right to access, use, and store location data

- Location data may be used for attendance verification, compliance, and business management

- You have no ownership rights in location data collected through the App

## 22. Mobile Device Requirements

### 22.1 Device Compatibility

- You are responsible for ensuring your device is compatible with the App

- The App requires certain device capabilities (GPS, internet connectivity, etc.)

- The Company does not guarantee compatibility with all devices

- You are responsible for maintaining your device in good working condition

### 22.2 Device Security

- You are responsible for securing your device

- You must use device lock screens and security features

- You must keep your device's operating system updated

- The Company is not liable for security breaches resulting from insecure devices

## 23. Data Backup and Recovery

### 23.1 No Data Backup Guarantee

- The Company does not guarantee data backup or recovery

- You should maintain your own backups of important data

- The Company is not liable for data loss

- Data may be deleted upon account termination

### 23.2 Data Retention

- The Company may retain your data for as long as necessary for business purposes

- Data retention is subject to legal requirements and employer policies

- The Company may delete data at any time without notice
